Thanks a lot, Senthil. So, does this patent agent exam happen just once in a year? I thought it was twice an year...dec/apr, and that's why I didnt apply in jan,...i lost my chance, that means...:-(!...and will have to wait till dec/2011 jan, right...?

Yes, I think from now onwards IPO made it once in a year only. Next exam is certainly NOT before Jan 2011 anyway. This time I found Paper II of patent agent exam little bit awkward, in sence; there was no choice offered to wright patent specification in your preferred field like before. You must answer all 2 questions related to Title/ Abs/ Claim drafting as well as full specification drafting. This covers 60 marks and rest of the 4 questions ( 10 x 4), where you have to provide suggections to your clients is sometimes leads you to confusing situation and lots of If's and but's. I really think the success raet for Jan 2010 exam will be around ~10% or may fall below, too! Even in Viva, I heard, those who appeared from Kolkata centre, felt a jolt as they were asked for "case laws". God knows if Indian patent office is trying to make this exam as IIT-JEE grade or IAS quality!

The patent agent exam specially paper 2 is always not easy for one without experience in patent drafting etc. Also the present tutoring courses for the patent agent exam are not very good .......guess we have to wait for some good courses for this exam

Hi Senthil,

Recently I have got an appointment from D.P.Ahuja & Co., Kolkata as an Associate Patent Agent. But, the contract they have sent me contains a strange clause that states that "neither during the term of your employment with us nor after its expiry or termination you will undertake to do any work for anyone else in the same area of business or profession , similar to the work done by D.P.Ahuja & Co., that is Intellectual Property Services of any kind. A seperate undertaking in this regard shall be given by you." I was shocked and on contacting their official, he told me that the clause is to this effect that I shall refrain from working in IPR even after I leave the organisation. Do you think that any organisation can put a bar on an employee's freedom in this way?

I am Sr. Officer- IPR in Nuziveedu Seeds Pvt. Ltd. Have done my M.Sc. (Plant Breeding and Genetics) and Post Graduate Diploma in IP and Technology Management in Agriculture from National Academy of Agricultural Research and Management in 2010. I had appeared for the patent agent exam for the first time this year, waiting eagerly for the result. Can I know the probable date/month for the results to be declared? If you can suggest me something alike course that would take me further, to enhance my knowledge in this field.

It is better to go for courses before appearing patent agent exam. However, you can directly appear the patent agent exam.

I have given the Patent Agent Exam twice (in Dec 2008 and Jan. 2010). But I m not able to qualify the Exam. In first attempt, I missed to qualify paper I only by 2 marks and got 59.58 % marks in aggregate. In second attempt, I got only 50% marks (only 40 marks in interview) but this time I was not able to qualify Paper I. I am not able to find out the lacuna in the preparation. How can it be possible for one to get less marks in Paper I if Paper II and interview are qualified with good marks. I am worried about it. Can any body guide me, where am I missing in doing the preparation. I have two year experience in Patents field of patent drafting and other patent practices, then where is the problem? Can anybody let me know what is lacking in my preparation?

I have just cleared the Patent agent exam and wanted to know if any official intimation by the govt is normally sent before one can register their name? The pdf with results tells us to apply directly, however, ppl who have cleared before told me to wait for an intimation (letter addressed to me) after which i shall have to pay up the 10 yr maintenance fee as well. Since you have gone through this, request your help

This is about new layout of the Patent Agent Examination. This examination is conducted in two parts- written test and interview. Written test will assess the technical knowledge of the candidate and interview is mainly to assess presentation skills of the candidate. The improvements by patent office in each and every niche area in last one year are appreciable. The examination for patent agent was carried out this year outside the patent office. I have seen four examinations (not as candidate all four times). To my understanding what has been achieved through this is sitting arrangement was more organized. What I really want to talk about is Interviews. Till then interviews were conducted by patent officials and two patent professionals. This patent field is not all that vast. Even in real big industry like pharma industry most of the professionals know each other very well. People working in patent field are very less in number and they know each other very well. Rather Patent Officials don’t know every one. They know only those people who appear before them as patent agent.

I am very sad to say that, the experience this time was very very unfair. Patent professionals interviewing the candidates were Proprietor of the Training Institutes for patents and what was really stressed in the interview was why the candidate has not joined any training institutes and one cant learn these skills on his own. Even names and locations of the Institutes were being told to the candidates. That was making very obvious that whoever is the student of the institute or whoever is working with them had a fair chance. Each and every candidate was discussing the same after coming out of the interview room. The professionals were not sitting for interviewing the candidates but for advocating their institutes. This was never the case before. There might be many stories about patent officials but to my experience, interviews were never conducted in such a odd way, after coming out of the interview room the candidate may be in a nervous or happy mood but no body used to get annoyed. Patent officials used to ask many tricky, difficult questions, but they were purely technical. This time’s interview part was saddening. Even though it was meant for introducing fair practices, at least to my experience, previous examination layout was far better. I do agree that one or two candidates might be getting favoured but at least there was no partial treatment to each and every candidate and candidates were not getting irritated with the type of questions asked. I say that previously 100% technical questions were there and this time technical part was 20 – 25 % and entire stress was how training institutes help you build your career I patent field. It was clearly seen that professionals were overpowering patent officials which should have been otherwise. To my opinion, no outsider should be involved in the process, patent officials are competent enough and definitely more fair than the professionals advocating their institutes and pampering their candidates.

Last time I had missed the exam by1%. This time I should not. Can any one tell me how to study the exam with examples(case study) because the last exam is not direct but with case study which can be clreaed only if we have practical experiance.
